All Naxos Historical, Naxos Classical Archives, Naxos Jazz, Folk and Rock Legends and Naxos Nostalgia titles are not available in the United States and some titles may not be available in Australia and Singapore because these countries have copyright laws that provide or may provide for terms of protection for sound recordings that differ from the rest of the world.
Australia
Effective January 1, 2006, Australia changed its copyright policy to 70 years, from 50 years. This means that all re-issues of recordings from 1936 to now are covered by copyright of the original issuer and cannot be sold by third parties (that would be us).
We only learned about the change some months after the legislation, so some items that were available for listening are now no longer accessible.
Any Historical/Nostalgia/Legends recordings we issued before January 1, 2006 are not blocked.
We regret that we can't do anything about the regular retailers but we cannot sell our products affected by this copyright change in the country.
United States / Australia / Singapore
It is much to our regret that we are unable to supply our US clients with all Naxos Historical, Naxos Classical, Naxos Jazz, Folk and Rock Legends and Naxos Nostalgia titles and some titles may not be available in Australia and Singapore because these countries have copyright laws that provide or may provide for terms of protection for sound recordings that differ from the rest of the world.
If you are in the United States, these recordings are not available to you by law. According to the New York Court of Appeals ruling, all recordings in the United States are considered to be in copyright forever. Until that ruling is overturned, no historical discs can be sold by us in the US. They are available in other countries and you, as a private citizen, are able to purchase and import them, but we, as a company, cannot sell or distribute them within the United States.
If you are in Australia or Singapore, as of January 1, 2006, all recordings in the last 70 years are in copyright and cannot be reissued by other companies, so some of the Naxos historical recordings are unavailable in those territories as well.
The US ruling covers all recordings; the Australia and Singapore laws only cover recordings issued since the date of the law coming into effect.
